1. Introduction
Welcome to Goldback Australia.
This website is operated by No Bull Bullion Pty Ltd (ABN 66 664 095 658), trading as Goldback Australia (“Goldback Australia”, “we”, “us” or “our”).
These Terms & Conditions govern your access to and use of our website, the creation and operation of customer accounts, and purchases made through our online store.
Goldback Australia operates as an online retailer and wholesale supplier of Goldbacks, Silverbacks and related products.
The website-use provisions apply to your access to and use of the website. When you create an account or submit an order, the applicable terms presented during that process govern the account or proposed transaction, subject to any mandatory rights under law.
These Terms & Conditions should be read together with our Privacy Policy, Shipping, Returns & Refunds Policy and, where applicable, Wholesale Account Terms & Conditions.
Nothing in these terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, restricted or modified, including applicable rights under the Australian Consumer Law.

Our postal address is provided for business correspondence and should not be used for returning merchandise without prior return instructions.
3. Eligibility and Website Use
You agree to use our website lawfully and to provide accurate and current information when creating an account, purchasing products or communicating with us.
You must not:
- Provide false or misleading personal, business or payment information.
- Impersonate another individual or business.
- Access another person’s account without authority.
- Interfere with the security or operation of the website.
- Introduce malicious code or attempt unauthorised access.
- Use the website in connection with fraud or other unlawful activities.
- Misrepresent your eligibility for wholesale pricing.
We may take reasonable steps to restrict website or account access where necessary to prevent misuse, investigate security concerns or comply with the law.
4. Customer Accounts
You may be required to establish an account to access certain services or purchasing arrangements.
You are responsible for maintaining the confidentiality of your login credentials and for taking reasonable steps to prevent unauthorised access.
You must notify us promptly if you become aware of a suspected security breach involving your account.
We may request information to verify account ownership or business authority before making sensitive account changes.
Customer accounts remain subject to applicable legal obligations, including the retention of certain transaction and compliance records.
Closing an account does not automatically cancel accepted orders or require the deletion of information we must retain by law.
5. Products and Descriptions
We endeavour to provide accurate and sufficiently detailed information about the products offered for sale.
Product listings may include information relating to:
- Product name, type and denomination.
- Manufacturer or issuing organisation.
- Metal composition, purity or precious-metal content.
- Weight and other specifications.
- Condition, grading or certification.
- Packaging, serialisation or edition details.
- Availability and applicable purchasing restrictions.
The description applicable to an individual product forms part of the information on which the customer may rely when deciding to purchase.
Product photographs may be representative where this is clearly indicated. Where the listing expressly offers the particular item pictured, the supplied item must correspond to that description.
Differences in screen settings may affect the appearance of colours and finishes.
We will not rely on photography disclaimers to excuse material inaccuracies in product descriptions or to exclude consumer rights.
Products described as graded, certified, limited-edition or possessing particular metal characteristics will be supplied consistently with the representations made in their listings, subject to applicable law.
6. Goldbacks, Silverbacks and Precious-Metal Products
Goldbacks, Silverbacks and other precious-metal-related products may possess characteristics that differ from conventional bullion bars and coins.
Their prices may reflect factors beyond their intrinsic metal content, including manufacturing costs, design, distribution expenses, demand, availability, collectability and commercial premiums.
Unless expressly stated and substantiated in a particular listing, we do not represent that a product:
- Is legal tender in Australia.
- Has an Australian government-guaranteed monetary value.
- Is approved or endorsed by a government or regulator.
- Is exempt from GST or other taxes.
- Will appreciate in value.
- Can be resold at its original purchase price.
- Can be readily exchanged for cash or other assets.
- Has a guaranteed buyback market.
- Is suitable for a particular investment or financial purpose.
Any manufacturer claims, metal-content specifications, certification details or other product characteristics must be considered in the context of the particular product listing.
7. Pricing and Currency
Unless clearly stated otherwise, prices are displayed in Australian dollars (AUD).
Retail product prices are generally displayed including GST where applicable, with the total price and any unavoidable charges presented in accordance with Australian pricing laws.
Delivery charges and genuinely optional services are shown before an order is submitted. Where a charge is unavoidable or pre-selected, it will be included in the total price as required by law.
Prices shown specifically to approved business wholesale customers may be identified as GST-exclusive where permitted. Where wholesale prices exclude GST, the GST component and the total amount payable will be clearly presented before checkout confirmation. These display conventions do not override any applicable requirement to show a tax-inclusive total price.
Product prices may change due to movements in precious-metal markets, foreign exchange rates, manufacturer pricing, supply costs, availability or commercial conditions.
Changes to prices displayed for future purchases do not automatically alter the agreed price of an accepted order.
We reserve the right to correct errors in listings or prices, subject to the order acceptance provisions and any rights available under applicable law.
8. Order Placement and Acceptance
Placing an order through our website constitutes an offer by the customer to purchase the selected goods on the disclosed terms.
Following submission, the website may generate an automated order acknowledgement, payment instructions or an email confirming receipt of the order.
Unless it expressly confirms acceptance, an automatic order-received acknowledgement, payment instruction or WooCommerce status notification (including an “on hold” or “processing” notice) is not, by itself, a confirmation of acceptance.
An order becomes accepted when we send a communication expressly confirming acceptance or dispatch the goods, whichever occurs first.
We will endeavour to review orders and communicate acceptance or any issue within a reasonable period.
Before acceptance, we may decline an order on reasonable grounds, including:
- Genuine unavailability of the ordered goods.
- A material and genuine listing or pricing error.
- Inability to verify payment.
- Suspected fraudulent or unauthorised activity.
- Failure to complete verification reasonably required for the transaction.
- Applicable legal or regulatory restrictions.
- Inability to supply the goods to the requested location.
If payment has been received for an order that we do not accept, we will arrange a refund of the amount paid within a reasonable period.
Once an order has been accepted, neither party has an unrestricted right to cancel or change it. Any cancellation, variation or remedy will be governed by applicable law, these terms and any additional terms agreed before acceptance.
9. Market Price Fluctuations
The prices of gold, silver and related products may fluctuate substantially over short periods.
Product values and retail prices may also be affected by foreign exchange movements, market premiums, stock availability and manufacturer pricing.
Customers acknowledge that market movements after an order has been accepted do not, by themselves, entitle a customer to demand a price reduction or cancel an otherwise valid purchase.
Likewise, Goldback Australia will not unilaterally increase the agreed price of an accepted order solely because market prices have risen.
Nothing in this section restricts a customer’s statutory remedies where goods are faulty, misdescribed or otherwise fail to comply with applicable law.
10. Payment Methods
Goldback Australia’s initial payment method for online purchases is direct electronic bank transfer (EFT), when checkout is enabled.
Only payment methods actually offered for a particular transaction at checkout or in the relevant invoice are available for that transaction. If additional payment methods are introduced later, any applicable provider terms or verification requirements will be disclosed where appropriate.
Customers must ensure that payments are made using the correct transaction reference and the verified payment instructions supplied for the order.
Payment is not considered received merely because a transfer has been initiated or a payment confirmation screenshot has been supplied.
Funds may require time to clear, particularly for a first transfer to a new bank recipient.
Customers are encouraged to verify payment instructions independently if they receive any unexpected request to change the nominated bank account.
We will never treat an unauthorised alteration of payment details by a third party as a valid instruction from Goldback Australia merely because it appeared in an intercepted or fraudulent message.
11. Payment Timeframes and Unpaid Orders
Any payment deadline applicable to an order will be disclosed before the order is submitted or separately agreed with the customer.
Where payment is not received within the agreed period, we may contact the customer to resolve the matter.
If a payment remains outstanding, we may take reasonable steps available under the contract and applicable law, including declining an unaccepted order or, where legally justified, terminating an accepted contract after appropriate notice.
We will not impose undisclosed penalties, arbitrary cancellation charges or unilateral price adjustments.
Any recovery of amounts lawfully owing will be subject to applicable contract and consumer protection laws.
12. Fraud Prevention and Regulatory Verification
To protect our customers and business, we may perform reasonable checks relating to:
- Customer identity.
- Business identity and ABN details.
- Authority to act on behalf of a business.
- Payment authenticity and transaction security.
- Suspected fraud or unlawful activity.
- Compliance with applicable AML/CTF, sanctions and other legal obligations.
We may request supporting information reasonably necessary for these purposes.
Where required or authorised by law, we may delay, decline or otherwise deal with a transaction in accordance with our legal obligations.
Information collected for verification purposes will be handled in accordance with our Privacy Policy and applicable law.
The nature and extent of AML/CTF obligations depend on the designated services and activities actually carried out by our business.
13. Stock Availability
Product availability shown on our website reflects the information available to us at the relevant time.
Although we take reasonable steps to maintain accurate stock records, discrepancies or technical errors can occur.
If an item becomes unavailable before an order is accepted, we may decline the order and refund any payment received.
If an accepted order cannot be fulfilled, we will contact the customer and provide an appropriate resolution consistent with the contract and applicable law.
We will not substitute materially different products without the customer’s agreement.
Preorder, backorder or future-release products will be clearly identified, together with the relevant fulfilment information and material uncertainties.
14. Shipping and Delivery
Goldback Australia operates exclusively online and ordinarily dispatches goods through Australia Post or another suitable carrier.
Available delivery options may include Express with Signature and Insured Shipping – Express with Signature, subject to the applicable service, destination and product conditions. The price of each option and any relevant restrictions will be disclosed before the order is submitted. Any insurance referred to in a shipping option relates to the business’s existing insurance arrangements, subject to policy terms, and is not a separate policy issued to the customer.
Delivery estimates may be affected by:
- Payment verification and clearance.
- Product availability.
- Required identity or compliance checks.
- Carrier processing times.
- Public holidays.
- Weather, transport interruptions or other events.
We will take reasonable steps to dispatch and deliver orders within the agreed timeframe or, where no timeframe is agreed, within a reasonable period.
We may use tracking, Signature on Delivery or other reasonable security arrangements where appropriate and disclosed.
Customers must provide accurate delivery details and cooperate with reasonable security requirements.
Responsibility for lost or damaged goods during delivery will be determined in accordance with applicable law and valid contractual arrangements.
Customers should contact us promptly if a parcel is missing, delayed, incorrectly delivered or damaged.
Our separate Shipping, Returns & Refunds Policy provides further information, including service descriptions and the handling of lost, damaged or incorrectly delivered shipments.
15. Returns and Change of Mind
Our ordinary policy is not to accept voluntary change-of-mind cancellations, returns, refunds or exchanges for Goldbacks and Silverbacks after order acceptance. For other products, including accessories, any voluntary return is subject to the product listing and the Shipping, Returns & Refunds Policy. We do not generally provide voluntary refunds or exchanges simply because a customer:
- Changes their mind.
- Finds a lower price elsewhere.
- Changes their investment or collecting preferences.
- No longer wishes to hold the purchased product.
- Is dissatisfied with subsequent market-price movements.
However, this policy does not affect rights and remedies under the Australian Consumer Law or other applicable laws.
If products are faulty, materially misdescribed, incorrectly supplied or otherwise fail to comply with applicable statutory guarantees, customers may be entitled to remedies including a repair, replacement, refund or compensation, depending on the circumstances.
We will assess such claims in accordance with applicable law. In exceptional cases we may agree to a voluntary return of non-faulty goods on separately disclosed and agreed terms, which may include the 25% restocking fee described in our Shipping, Returns & Refunds Policy. That fee does not apply where its imposition would unlawfully diminish a statutory remedy.
16. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law where that law applies.
A customer may be entitled to a replacement or refund for a major failure and compensation for other reasonably foreseeable loss or damage.
Where a failure is not major, the supplier may have an opportunity to remedy the failure within a reasonable time, subject to the law.
The rights available depend on the circumstances of the transaction and the nature of any failure.
Nothing in these Terms & Conditions is intended to exclude, restrict or modify consumer guarantees or remedies where doing so would be unlawful.
Some business purchases, including certain acquisitions for resale, may fall outside particular consumer guarantee provisions. Other statutory protections may nevertheless apply.
17. Product Authenticity, Condition and Claims
We aim to supply authentic products consistent with their advertised specifications.
Where a product is advertised as carrying a particular manufacturer designation, grade, certification, metal content or condition, that representation forms part of the product description.
If a customer believes that an item is inauthentic, incorrectly graded, damaged or inconsistent with its advertised description, they should contact us with their order information.
We may reasonably request supporting evidence or inspection of the item.
Claims will be handled in accordance with the contract, relevant evidence and applicable consumer protection laws.
Normal manufacturing variations or characteristics accurately disclosed in a product listing do not automatically constitute defects.
18. No Financial or Investment Advice
Information published by Goldback Australia is provided for general product, educational and commercial purposes.
Unless expressly stated otherwise and supported by the necessary authorisations, it does not constitute personal financial advice, investment advice, taxation advice or legal advice.
We do not assess whether a particular product is suitable for an individual’s financial circumstances.
Precious-metal and collectable-product markets involve risks, including price fluctuations, premiums, limited liquidity and differences between purchase and resale prices.
Past performance does not guarantee future outcomes.
Customers should obtain independent professional advice when appropriate.
19. Wholesale Customers
Wholesale accounts are subject to a separate application and approval process.
Submitting a wholesale application does not guarantee approval, access to wholesale pricing or ongoing eligibility.
Approved wholesale accounts may be subject to:
- Business and identity verification.
- A minimum online wholesale order value of A$5,000 excluding GST, unless a different arrangement has been expressly agreed in writing.
- Product-specific minimum quantities or ordering multiples.
- Wholesale pricing arrangements applying only after account approval.
- Additional payment and account conditions.
- Applicable compliance requirements.
Any applicable product-level quantities, pricing and minimum-order requirements will be shown through the shop and checkout. These arrangements are further described in our Wholesale Account Terms & Conditions and relevant product or checkout information.
Approval of a wholesale account does not create an agency, franchise, employment relationship, exclusive distributorship or other commercial appointment unless separately agreed in writing.
Where a specific written wholesale supply agreement has been entered into, its terms will govern the relevant transactions to the extent of any inconsistency, subject to applicable law.
20. Intellectual Property
Unless otherwise stated, the website’s original text, design, layout, graphics and content owned by Goldback Australia are protected under applicable intellectual property laws.
Product images, names, trademarks, designs and manufacturer materials belonging to third parties remain the property of their respective owners.
You may access and use the website for lawful personal or business purposes.
You must not reproduce or commercially exploit protected website materials without appropriate permission, except where permitted by law.
Nothing on the website transfers ownership of intellectual property rights to a visitor or customer.
21. Third-Party Services
Our website may incorporate third-party services, including payment services, shipping providers, website infrastructure, account security systems and other technology.
Certain third-party services may be governed by additional terms presented by the relevant provider.
Goldback Australia is not responsible for unrelated content published on independent external websites.
However, this provision does not remove our responsibility for products or services we are legally required to provide.
22. Website Security and Availability
We take reasonable steps to maintain the website and protect its operation.
The website may occasionally be unavailable due to maintenance, technical faults, security incidents or interruptions beyond our reasonable control.
We do not guarantee uninterrupted website access.
Where an outage affects an existing purchase, we will continue to honour our obligations under accepted orders and applicable law.
23. Liability
Nothing in these terms excludes, restricts or modifies any statutory right, guarantee or remedy that cannot lawfully be excluded, restricted or modified.
Subject to those rights and to the extent permitted by law, each party remains responsible for its own acts, omissions and breaches of these terms.
We do not accept liability for losses that are too remote or are not recoverable under applicable law.
We will not rely on this section to avoid liability for statutory consumer guarantees, misleading conduct, fraud or any other liability that cannot lawfully be excluded.
Any limitation of liability must be interpreted consistently with Australian Consumer Law and applicable protections against unfair contract terms.
24. Complaints and Disputes
If you experience a problem with an order, product or service, please contact us:
Email: info@goldback.au
Phone: 1300 427 866
Please provide relevant order details and a description of your concern.
We will review complaints in good faith and endeavour to resolve them within a reasonable period.
Nothing in these terms prevents a customer from contacting an appropriate government regulator, exercising statutory rights or commencing lawful proceedings.
25. Changes to These Terms
We may update these Terms & Conditions to reflect changes in law, business operations, products or website functionality.
Updated terms will apply to future transactions as permitted by law.
Changes will not retrospectively alter the agreed price or other material rights and obligations under an accepted order without an appropriate lawful basis or the parties’ agreement.
Material changes affecting ongoing contractual arrangements will be managed consistently with applicable law.
26. Severability
If any provision of these terms is found to be invalid, unlawful or unenforceable, that provision will be ineffective to the extent required by law.
The remaining provisions will continue to operate to the extent they can lawfully do so.
This clause does not validate an otherwise unfair or unlawful contract term.
27. Governing Law
These Terms & Conditions are governed by the laws of Queensland, Australia, subject to applicable Commonwealth legislation and any mandatory laws governing the transaction.
Nothing in this section limits a person’s rights to bring proceedings in a court or tribunal where applicable law permits.
